1. GENERAL PROVISIONS
1.1. By accessing www.charath.com or placing an order for PrintWell filaments, 3D print farm rentals, or custom 3D-printed products, you ("Customer", "User") agree to be bound by these Terms and Conditions.
1.2. We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our services constitutes acceptance of the modified Terms.
2. PRODUCTS, SERVICES & PRINTWELL BRAND
2.1. PrintWell Filaments: We aim to display accurate colors, weights, and technical specifications for our PrintWell filament line. However, minor batch variations in spool color or spooling appearance may occur.
2.2. Print Farm Rentals & Custom Manufacturing: All custom 3D-printed decor, furniture, and lighting features are manufactured based on specifications agreed upon in writing or submitted via CAD/3D model files. Customers are responsible for verifying the accuracy and structural integrity of user-supplied 3D models.
3. PRE-ORDERS, TIMELINES & SUPPLY CHAIN ACKNOWLEDGMENT
3.1. Delivery Window: Standard Pre-Orders for PrintWell filaments or large-scale materials carry an estimated delivery timeframe of thirty (30) to forty-five (45) business days.
3.2. Transit & Logistics: The Customer acknowledges that Pre-Order items may be in manufacturing in China, in maritime transit, or undergoing UAE port customs clearance at the time of purchase.
3.3. Delays: While we strive to meet all estimated timelines, Charath Marketplace is not liable for shipping delays caused by sea freight disruptions, port congestion, customs clearance holds, or third-party carrier delays.
4. PAYMENT TERMS & PRE-AUTHORIZATION
4.1. Standard Orders: Full payment is required at checkout for in-stock products prior to shipment.
4.2. Pre-Orders & Custom Projects:

A non-refundable advance deposit is required to secure Pre-Orders and initiate production or logistics allocation.

The remaining balance is due prior to or upon physical delivery/handover.4.3. Card Pre-Authorization & Installment Links (Tabby / Tamara):

To secure Pre-Orders, customers agree to card pre-authorization or payment link generation via Tabby, Tamara, or direct payment channels.

Pre-authorized charges or installment plans will be processed upon order dispatch or delivery notification.4.4. Direct Bank Transfers: For manual bank transfer orders, proof of payment must be sent to sales@charath.com or via WhatsApp (+971 55 713 5002). Orders will be dispatched only upon clearance of funds in our official UAE bank account.
5. CANCELLATION & REFUNDS
5.1. In-Stock Orders: In-stock orders can be canceled before dispatch for a full refund. Once shipped, standard return policies apply.
5.2. Pre-Orders: Because Pre-Orders involve international material allocation and logistics, Pre-Orders cannot be canceled once production or maritime transit has commenced. The 25% advance deposit is non-refundable.
5.3. Custom Printed Products & Farm Services: Custom decor, lit/non-lit pieces, printed furniture, and reserved print farm capacity are non-cancellable and non-refundable once production has started.
6. Payment Default & Post-Delivery Overdue Penalty

Payment Terms: For orders delivered prior to full settlement, the remaining outstanding balance is strictly due upon receipt of the delivery unless alternative written credit terms have been agreed upon.

Grace Period: A 7-day (1 week) grace period from the delivery date is provided to clear the payment without incurring additional charges.

Overdue Balance Fee: If the invoice balance remains unpaid after the 3-day grace period, an overdue account penalty of AED 0.65 per kilogram per month (calculated added to invoice in advance on the total shipment weight) will automatically accrue on the outstanding balance until the invoice is paid in full.

Retention of Title & Repossession: All delivered goods remain the sole property of Charath LLC until the full invoice amount, including any accrued late fees, is settled. Charath LLC reserves the legal right to retrieve or repossess unpaid materials from the customer’s warehouse or premises at the customer’s expense if default exceeds 30 days.
7. SHIPPING, DELIVERY & INSPECTION (UAE)
7.1. Deliveries across the UAE (Dubai, Abu Dhabi, Sharjah, Ajman, RAK, UAQ, Fujairah) are fulfilled via local logistics carriers or internal delivery fleets.
7.2. Inspection Period: Customers must inspect delivered products immediately upon receipt.
7.3. Claims: Any claims regarding damaged spools, incorrect material types, or missing items must be submitted to sales@charath.com or WhatsApp (+971 55 713 5002) within forty-eight (48) hours of delivery, along with clear photo/video proof.
8. LIMITATION OF LIABILITY
7.1. Charath Marketplace shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our filaments, 3D print farm outputs, or custom product installations.
7.2. Operating 3D printing equipment with PrintWell filaments remains the user's responsibility; Charath Marketplace is not responsible for hardware issues caused by improper printer calibration, incorrect temperature settings, or user error.
8. GOVERNING LAW & JURISDICTION
These Terms and Conditions shall be governed by and interpreted in accordance with the commercial laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
